In this work, we tried to show the importance that the contract plays as an enabling instrument of modern contractual relations, in view of the increasing increase of real estate transactions. As a result of this increase, the need arises to have the assistance of a lawyer specialized in Real Estate Law along with a Real Estate Broker to monitor the advisory of the purchase and sale of real estate in order to ensure the safety of the legal business and avoid possible losses and damages. This project aims to show how it occurs in practice the performance of the Real Estate Broker without the presence of the real estate lawyer to advise the promissory buyer at the time of acquisition of the property, with respect to its regularity and the contractual clauses, thus avoiding that the acquirer feels harmed as a result of possible bad faith of the Real Estate Broker.
