Freedom of the press is a guaranteed fundamental freedom. Almost all democracies have understood this and have emphasised or simply highlighted it. It appears to be one of the necessary conditions for effective citizenship, allowing full expression of the faculties of action and expression accorded to individuals. Its examination, in relation to the judicial judge in the general system of fundamental freedoms, will have enabled a better understanding of the problem in a developing country such as Burkina Faso. The individual can only be a player in society, a citizen, participating in the life of the country and possibly criticising government policies, if he can free himself from the fear that is likely to engender various forms of arbitrary repression by the State.
