The media sector is extremely sensitive regarding law and legal policy. Economic conditions are confronted with the public interest of ensuring plurality of opinion. Furthermore, the theory of two-sided markets, founded by the Nobel prize laureate of 2014 Jean Tirole, challenges the present practice in merger control and the regarding law. This interdisciplinary work examines this conflict while specifically respecting the different economic and legal perspectives. Merger control cases as the prohibited merger of ProSieben and Springer are used to conduct a practical test of the economic theory. Hereby, the work shows necessary legal changes as well as where and in which way economic insight has to be considered in merger control.
