Criteria for data transport on the Internet and the ability of cable companies to influence it have already become leading questions for the digital society. This contribution establishes guidelines resting upon German constitutional law and to illustrate the relationship of the technically possible and the legally acceptable. The constantly advancing digitalisation the corresponding convergence of content and networks emphasizes emphasise the regime for data transportation. The structures influenced by such interference in data tranportation are diverse and interdependent. This work categorises various possibilities of network management and evaluates them especially considering the basic rights and contrasts the findings against the existing legal framework.
