»The Limitations of Judicial Power in Private Law«: The thesis analyzes the limits of judicial power in private law and, to that extent, the delimitation of judicial and legislative power under the German Constitution. The methodological study explores the prerequisites and scope of judicial decision-making and results in a comprehensive system that provides guidelines to determine whether the creation of judge-made law is permissible or impermissible.
