The present work offers a complete compilation of all legal questions concerning the claim to partitioning of the estate. It begins with an analysis of the German laws concerning the community of heirs and the different ways of its partitioning. Then, a historic chapter follows which focuses on the legislative procedure of the German Civil Code. The main chapter firstly enlightens the legal nature of the claim to partitioning of the estate; then, the conditions of a successful claim to partitioning of the estate are displayed one after another. The work concludes with remarks on the claim to partial partitioning of the estate and with the attempts of reforming the law of partitioning of the estate.
